I am willing to donate 100 (or more if they can be used to help) cd's I have recorded of classical guitar music if a fund raiser or some event is in the works I have 2 cd.s both are acoustic classical guitar and on the mellow side. I am also willing to perform if a fund raiser should arise. hopefully I will be available and not gigging or guiding. Some of the music can be heard at ernesto@ernestoale.com Respectfully EA

Living trust is a generic term for any trust set up for someone during their lifetime. Doesn't have to be for tax reasons. Tyrus is the beneficiary. Someone else is setting it up, the trustor. And someone has to administer it, the trustee.

In those marital trusts the trustors and trustees are the same, the married couple. They control their own assets during their lifetime. Here Tyrus needs someone to manage the money for him, at least until he is an adult.

On another thread or two, I posted this or a version of it, and now I see it belongs here:

Honoring John's Memory

"... I have no words for the death of John, only immense sadness and, now, concern for his son especially and hope there will be a fund or other mechanism so we who stood in awe can take some small positive action in line with our admiration for John, though any such action will hardly stand against the dismay and grief ... any word on whether his family and/or friends are setting up a fund in memory of John for either his son or for works or services John would want supported, or perhaps for a memorial plaque or book or something in his honor?"

OK, so now I see there is a trust fund established presumably by family and attorney. I'm in right now but wonder about longer term. Sure would be good to hear directly from a family member to announce the fund, say a bit about the particulars to give maximum exposure, confidence and understanding to contributors. Maybe this will be coming as we stay tuned. Then there are later questions about some representation of John in an appropriate place, plaque or otherwise, and of course an honorary book, all for later I presume.

I'm the attorney setting up the Tyrus Bachar Trust and I am going to try and answer some questions that are popping up on this list. I can't get all of them because some I don't know the answers.

The Trust will have four trustees. The trustees have been asked and agreed to serve as the trustees. Those are Robin Thompson, Paola Accusani, John Bachar Jr. (John's Father) and Steve West.

Any amount of money can be donated either by check, going to a Wells Fargo bank or PayPal. At the same time, at the Outdoor Retailer Trade Show we will be asking everyone in the room.

The "fund" is actually a trust that I have written. I've written over 100 of these trusts.

I'm sure, when Tyrus is ready, he would love to know more about his father and have some fun with people in the outdoors.

More answers as I work through this thread.

"Living" is mostly a term that is used to market trusts by people. The term was added before I got involved. At one point it meant it was active rather than dormant or waiting to be funded. Trusts can have many purposes: tax avoidance, long term control of money, better control of assets, etc. In this case it will be a trust to receive funds to be administered for the health, education and welfare of Tyrus.

The trust will be revocable. After a while or after the funds have diminished or been spent there is no need to keep the trust going. The trust is being set up to get Tyrus through college at present.

Donations can be mailed via Pay Pal using the email tbacharlivingtrust@gmail.com. For donations of any amount, please make checks payable to: Acopa USA/ TBLT, 2328 Jeanne Drive, Las Vegas, NV, 89108. Contributions can also be made at any Well’s Fargo Bank using the account name Tyrus Bachar Living Trust located at zip code 92626

hey there tyrus... say, just dropped in... i think i may have already... but just a reminder:

i may not be able to give, but when i had my kids, i had tons of prayers to get us through, and we made it through the hard times... so, i have these prayers still ready to go, and they will be for your growing-up day, as well...

Of course thanks for setting up mechanics of fund. So many mundane details next to the enormity of John's death, but all important to support of Tyrus. As for spreading the word to maximize donations, hope someone with the family or one or all trust members will get notices in all relevant climbing magazines, websites, obits and the like. Speaking from a bit of experience, I know how these donations spurt at the start then dwindle without constant attention. Don't know if AAC should be approached too, but another avenue worth exploring.
