Ammon McNeely was arrested eighteen days ago, on August 19, 2010.

Six days ago, on August 31, 2010, JesseM, the climbing ranger posted:

For US Court federal documents you can use www.pacer.gov (public access to court electronic records).

A criminal complaint was filed by the NPS for this case that outlines the facts and legal reasons for the charges against Ammon. This is a public document.


I can't/won't get involved on this forum as far as the reasons for the arrest and tasing of Ammon, the charges he faces, or the legalization of base jumping.

The case will go through the legal process, and a Federal Judge will review evidence and arguments including legal reasoning set forth by opposing parties or litigants to come to a decision which determines rights and obligations between the parties involved.

There will be a use of force review panel for the incident (as always).

MTucker posted the Use of Force Continuum for Law Enforcement. This is similar to the NPS standard.

Where is the criminal complaint? People here on this board have checked PACER and it is not there. Also, as far as I can see, the Park Service also has not made any press release or released any other information regarding the incident.

Is this normal?

Is it possible that the Park Service is reconsidering its position, or that the DOJ is reluctant to file?

Many here have wisely refrained from forming any opinion until more complete information has been available, but there appears to be a lack of transparency here.

one last thought,

i would rather be brought down by a billy club to the right shoulder,

than by a taser.

at least i know what the club feels like,

but that means getting in real close like.

i think tasers are great for small cops or maybe female cops,

but i bet this is the first person tazed in a national park.

over at jellystone park they only use the tasers on grizzzzzz...

Hahahaha, Its probably not a good idea to BASE jump with a BAC of .13, have an ounce and paraphernalia in the car with food improperly stored in your vehicle, and you and your girl run from officers after being told to "Stop, or you will be tased". Jus sayin...

Speaking practically, whatever issues there are here will have to be adjudicated in a court. I would also expect the case traffic out of the NPS is small compared to that from a large municipality so the time for processing will be more determined by staffing.

If we wish to have faster response to planned noncompliance in National Parks taxpayers will need to fork over more money for lawyers.

This incident could be bigger than it seems.

Instead of one misdemeanor crime, Ammon(and Girl) could be facing much, much more.

Base Jumping(accomplice)
Resisting Arrest
Fleeing the scene of a crime
Ignored lawful order
Lying to the cops
Drugs
Public intox
food storage

Ammon probably floated in while the fuzz was clearing the Meadow and checking cars.

Not good planning.

Ammon's personality + booze + adrenaline does not equal standing there like a statue after being caught for BASE.

So with him being on the radio, steph's video, claims of brutality and so many friends crying foul: I bet his plea deal will not be very generous.

The more you fight it the more the DA will make up for his/her time and effort.

As in up close and personal choke hold da mutha' tell he does the 'funky chicken' kinda close.

Happened to me one chilly Spring night around 10pm as I was taking a pee on a large Doug Fir tree in the Yose Village. Suddenly a bright light exposed my personal parts, so I scooted to the left behind the tree. Then to the right as it followed me back. Hey I was just trying to take a leak.

Suddenly, mid stream(so to speak)I felt a hard object across my adams apple, and started doing the funky. The air being cut off from my brain, I soon found myself cuffed, faced down in the dirt, unconscious.

LEO #1- With some guy either kicking or poking me from above, I regained consciousness hearing "Why were you hiding from us? Why wouldn't you come out from behind the tree?"

ME- "I was taking a pee! What did you expect me to do?"

LEO #2- To LEO #1 after checking the doug fir, and evidently seeing pissed on bark "This ain't our guy, let him go!"

And off they went.

Ammon should request a change of venue. My friend let the air out of a ranger's tire (really dumb) and got caught. In judge Pitt's court he requested a change of venue and got it moved to fresno and they let him off (he plead a moment of insanity). They probably don't even know what base jumping is in Fresno.

I really don't know if a parachutist (FAA License) is required to use a wingsuit, but if the FAA IS involved, there is a 0.04 BA limit SET IN STONE for "flying."
