2 police officers charged in death of Calif man

SANTA ANA, Calif. — Two police officers have been charged in the death of a mentally ill homeless man in Southern California who was beaten and repeatedly shocked with a stun gun during his arrest, authorities said Wednesday.
Orange County District Attorney Tony Rackauckas said Wednesday that Fullerton police Cpl. Jay Cicinelli was charged with one count each of involuntary manslaughter and excessive force.
Police Officer Manuel Ramos was charged with one count each of second degree murder and involuntary manslaughter in the death of 37-year-old Kelly Thomas after a violent confrontation on July 5 with officers.
Six officers were placed on paid administrative leave after the incident that occurred while police were investigating reported vehicle break-ins at a transit hub.
Thomas suffered severe head and neck injuries and was taken off life support five days later.

(Orange County DA) Rackauckas says Ramos "set in motion the events that led to the death of Kelly Thomas." He went on to describe the events that took place on that fateful July night, calling Ramos' actions as being "reckless" and "in conscious disregard to human life."
Ramos' behavior during the confrontation with Thomas as described by Rackauckas was dramatically out of line with police protocol. Rackauckas says Ramos knew Thomas, and that Thomas' behavior clearly indicated he did not have full control of his mental faculties.
"We're going to eff you up," Rackauckas says Ramos announced to Thomas, signaling a violent beating to come. The DA says he believes Ramos knew he was putting Thomas' life in danger, and that he was acting deliberately to hurt him badly.
If convicted, Ramos faces a sentence of 15 year to life in state prison.
Additionally, Crpl. Jay Cicinelli faces charges of involuntary manslaughter and use of excessive force.
Rackaukas revealed the official cause of death in the case as "mechanical compression of the thorax," which made it impossible for oxygen to travel to Thomas' brain. The other physical injuries Thomas sustained also contributed to his death.....

Police brutality is a real concern.
My closest friends, immediate family, and I were victims of police brutality. On top of having to recover from trauma/injuries, we also had to $$$legally$$$ clear our names because the police conjured up false charges.
I don't know the details of this case (OP), but it's nice to see the police actually being charged (which is rare).

Scared and bleeding, Kelly Thomas begged for his life to no avail as Fullerton police officers beat him and Tasered him in a violent confrontation that led to his death, Orange County Dist. Atty. Tony Rackauckas said at a news conference Wednesday.
Rackauckas gave a painfully detailed narrative of the July 5 events leading up to Thomas' death -– details that he said resulted in second-degree murder and manslaughter charges being filed against two police officers.
Rackauckas said Officer Manuel Ramos put latex gloves on his hands and brandished a fist at Thomas. Then, Rackauckas said, the officer, in a "menacing" manner, threatened Thomas: "These fists are ready to F you up."
Ramos knew Thomas, a homeless schizophrenic man who frequented downtown Fullerton, and Rackauckas said the officer should have realized that he was mentally ill and having difficulty following commands.
"Kelly Thomas appeared to be acting in self-defense, in pain, in a state of panic. His numerous pleas of 'I'm sorry,' 'I can't breathe,' 'help,' 'Dad,' all to no avail," Rackauckas said. "Screams, loud screams, didn't help."
Six officers were placed on leave after the beating, but Rackauckas said he filed charges only against Ramos and Officer Jay Cicinelli, who is accused of excessive use of force and involuntary manslaughter. The other four officers were not charged and were unaware of the statements and threats made by Ramos, the district attorney said.
Cicinelli allegedly Tased Thomas four times, kneed him in the head twice and hit him eight times with the Taser, Rackauckas said.
"Kelly Thomas was not responding when blows to his face occurred," Rackauckas said, adding, "That is not protecting and serving."

happiegrrrl - Cicinelli, one of the officers above has just one real eye. He lost the other as a rookie cop.

The murder of Kelly Thomas is only the most egregious case in Fullerton.
Here is a page from a recent Fullerton City Counsel meeting agenda.
Check out the slew of new legal threats against the city on this week’s agenda, ironically followed by salary and pension negotiations with the unions whose members caused these problems in the first place.

I deal with drama and some death and corrupt law enforcement and district attorneys at my job, but this has me disgusted like never before.
Fat cops, probably picked on in high school and wants some revenge - I know the types - something has clicked off and these people chose to be cops
Things like respect and honor, big in the world of criminals and gangsters is also rampant in law enforcement -
and I love the cop donned latex gloves to keep his manicure looking good before he beat the mental patient to death
and why are these pigs allowed "paid leave"
If i beat someone to death - I doubt if my employer would continue to pay me
This, to me is one more shining example that law enforcement officers are just people - lazy, ignorant, selfish and limp - not heroes putting their lives on the line to protect others
just people -
can't wait to follow up on these turds in 10 years when they're school teachers or social workers---------------------------

Does your job include that you may have to shoot or use force against people for your own safety?
If convicted of all charges, Ramos could face a maximum sentence of 15 years to life in prison. Cicinelli could face a maximum sentence of four years if convicted.

Let them have a fair trial. They are not guilty until they are convicted by a judge and jury.
I'm just glad that the DA is pressing charges and going to take it to a judge and jury. If it had been anyone else, they would have been arrested long time ago.

I live just down the street from where this happened, and it was sickening. Kudos to the citizens of Fullerton for rallying, and making it known, that they will not allow something this heinous go down with out a fight, and for standing up for the rights of a mentally I'll man who was murdered by those who are supposed to help. I am curious as to why the other four police Officers were not charged... Maybe the DA is still reviewing the case. Either way, I hope these shitbags get taught a lesson in prison that is at least half of what they inflicted on that poor man...
