Ho man, talk about police intolerance. Me and my buddy (at the time, A Hairhead, since converted to geekhood), are leaving the Pruneyard in San Jo and pull onto Campbell Ave, and BAMM!!!, we get the 'task force hood lights', I pull over.

He does the ritual and, on Jan 1st, asks if I've been drinking. I say yeah, we just had 2 beers each with lunch (actually close to a pitcher...kinda). "Get out".

So I walk the line, jump through tests, blow a breath-a-lizer 3 times, nuthin'.

Know what they popped me for?

Funny too cause they thought they had 2 potheads and half the time I'm running tests, my buddy is talking about customizing Turkish Mauser rifles to one of the cops. They found a gun-cleaning kit in my car and sounded the 'radical White-dude' alarms.

Funny cause you;ll never guess what they actually popped me for.

It shouldn't be any of The Man's business how much money an American has on his person or anywhere else.

Totally NOT OK with the facts as presented by plaintiff and their lawyer. The whole process of civil forfeiture stinks.

But, the plaintiffs are pursuing civil litigation seeking the return of their money, damages for pain and suffering, and punitive damages. So questioning their testimony is fair game.

As I wrote previously, "If the cops had the suspects sign a sheet forfeiting their cash in exchange for no time or loss of children, I think they should do time, and/or be found civilly liable."

Sorry for being disrespectful earlier. I am jaded as I see so many lying plaintiffs and ethically challenged lawyers in my work, that I question all allegations, and do not beleive media reports. Cheers,

If they got you on nothing, they should get nothing.

Suspicion, background, BS. If they can't write you a citation, or make an arrest with charges that the DA will want to file come Monday morning, they shouldn't be allowed to take your stuff.

The only time The Government should ever be authorized to take anything away from an American is in the case of stolen property, and then it should only be taken to be returned to the rightful owner.

The IRS and this Texas Cop both operate the same, they are just wearing different uniforms.

I have some real issues with this, as well as some real issues with some of the responses here.

What's with the guilty until proven innocent crap? Kinda makes you no better than the criminal pigs we're talking about, really. It's the same "philosophy" anyhow.

If these people were doing something wrong, committing some offense, you'd think they'd be filing charges for those offenses. There's no mention of that, and it doesn't seem to be the case. Seriously, money laundering charges for having $8500 in cash??? I guess I've laundered money a number of times in my life then, cause I've had that amount of cash on me before. I Must be a real criminal, since I have considerably more than that in a safe deposit box at my bank.

"Texas law allows police to confiscate drug money and other personal property they believe are used in the commission of a crime. If no charges are filed or the person is acquitted, the property has to be returned. But Guillory's lawsuit states that Tenaha and surrounding Shelby County don't bother to return much of what they confiscate."

This tells me charges are not being filed in MANY of these cases, and that they are simply extorting cash from people under the assumption that most people will not fight for their rights or what is theirs. Especially when it comes to the police. We have similar laws here, in Cali.

Thing is, there's a process for this. A cop can't pull you over, search you and your car and take your cash or belongings. Not unless he's crooked - Of course, then he has to lie or plant evidence to create probable cause and commission of a crime. If there were numerous complaints, a law suit, etc. all against the same cop, or group of cops, there'd be something done about it.

It's funny that there is no mention of any of these people doing anything to warrant a search of a vehicle or anything other than being pulled over and cited. If there were any valid reasons, with all the press this is receiving, the town would surely be making those things known and defending themselves in some fashion.

The document Henderson signed doesn't even begin to sound legal either. Suddenly, agreeing to forfeit cash decides whether or not the state seizes your kids or there are criminal charges being filed against you? Ummm, not in the real world.

Bottom line - if something looks, feels and smells like sh#t, it's most likely sh#t.

If what these officers in Texas did was wrong they should be punished. I wasn't there I don't know the whole situation, so I won't comment if it was right or wrong.

As for those of you on here they say all cops are corrupt and you're not safe why not take a look at this. Just keep in mind it's only May.

i didn't read the thread entirely, but i did not notice anyone chastizing all cops everywhere. i personally love cops- most cops. i have friends who are cops. i try to be nice and polite and genuine when i speak to cops.

that said-
if you give ANYONE power that can be abused, it's likely to be abused.
there are checks on abuse by police which are generally effective, but to characterize people, those who criticize the behavior of something/anything done by "the police", as some sort of ungrateful cop bashing anarchists, is itself plainly ignorant behavior.

these powers on confiscation, if in fact "legal", are ripe for abuse, and it stands to reason that they'd show up being abused where an empowered ethnic majority was able to wield the authority over a minority population.

truth is, this sort of thing happens all over the globe. we should all want to see it prevented from happening here.



btw- comparing theft of any kind to federal income taxes basically defines you as having a "fringe" mentality (which most of the rest of us equate w/ am radio fanaticism), and what's more, it demonstrates how little you personally know about the true intent of the founding fathers of this nation, most of whom wanted massive estate taxes, in order to prevent the rise of a ruling class which in their view, would be exceedingly likely to find ways o infringe upon the liberty of free americans, but i digress...


(would you be willing to have almost no income taxes if you could leave almost nothing as inheritance to your kids? it would certainly put more americans on an even playing field, wouldn't it?)
