i don't believe it until i see the scanned letter, and even then i would doubt that dean potter would actually have had the interest level to bother with some guy noone ever heard of rapping about him (fyi- everyone who might hear that song and actually know who DP is, already has an opinion on the DA photo-op).
for one thing, the song really is pretty funny (here is the page):

and what's more, he's not really saying anything there that's not true of lots of sponsored climbers.
...and it is true that DP's well publicised 'response' to the whole DA fiasco was to go on that often publicised soloing binge (complete w/ write-ups in climbing mags and video of him soloing 'heaven' on the patagucci website- so the guy has a good point (IMO) that it's a bit of a humorous reaction to an over publicized climb, for him to go out and publicize more climbs.

The mags, even NPR covered this fiasco--but something negative (Odub's song?) comes along and watch out, feelings are now involved and lawyer wanna-bes say that there are damages?

Piton Ron... I hardly have the time or patience to write out a letter like that. I assure you this isn't bogus.
He wants his freedoms, and I want mine. I don't want to profit off of his name in the slightest. I donated all my shows for the year so that any money normally spent on me can go to access. The song is a totally free download now as well. I also don't have the time or patience to actually make money from music. Its a hobby. Period.

I don’t know Dean so I really can’t judge him, and even if I did know him I probably wouldn’t judge him.
Of course I don’t know Cheney or the Shrub but I can certainly judge them, or at least be critical of them.
However, having just listened to the song (I never would have except for this thread), I don’t see anything wrong with the song, it is sort of catchy. Does it defame Dean? Not in my eyes (or is that ears?).
A Crowley, you are right insofar as mention of a legal letter is posted on that Red River site (I guess that is the only place), and we do not know if a cease and desist letter was actually sent.
But if it proves to be true, it is sort of lame of Dean for taking such an action.
Oooppps, did I just judge him?
BTW, I don't know this Odub either.

I don't have any reason knott to believe Odub - I think he did get that letter.
The question is: is it for real, or is it a big joke sent by a troll who's watched a TV show or two?
It should be easy enough to check the name of the alleged lawyer against records from
the state of origin's Bar Association to see if they are indeed licensed to practice law.
Also, why remove the name before posting the letter here? What is the down-side of leaving it?

I was out of supertopia when the DA climb happened and I didn't really care to much either. Just for my knowledge. Was his climb really illegal? Did he recieve a ticket? Or a warning?How did it affect climbing access? Wasn't that arch already closed? If so is it MORE closed. Did the land manager say the formation was damaged? (how) My 350 sq ft main sail is WAY smaller than the suface area of the arch, so any wind puts huge loads on the arch. I don't think DPs' 200lbs would affect it. Did he chalk tick the lights out of it or something? Or bolt it up. I am kind of in the dark as to what really occured.
I must be pretty evil as well, because I plan on climbing ship rock before I die.

Quite the letter, hard to imagine a lawyer would actually write it believing anyone would take it seriously. These rarely do much good as illustrated long ago by the WoS team when, as per established C4 legal protocols, their attorneys were presented with just such an order by the legal representation for C4-dirtbag-wizards-at-large, et al. Not withstanding the long tradition of attorneys and seconds settling Valley and Patagonian climbing disputes, this might be simply another case of an embarrassment in search of its rightful owner.

my peripheral understanding of the DA issues:
DP et. al. claimed they hadn't broken the law because it was a 'fixed anchor ban' and not a 'climbing ban'.
they somehow chucked a TR up over the arch to rehearse it, then apparently built a gear anchor on top. it seemed as if lines then were repeatedly rapped and/or jugged, all of which activity may or may not have created any sort of visible impact upon DA (most likely not, but i think someone claimed that if the full moon was at exactly the correct angle and a 4' parabolic mirror was employed by a 13 year old on top of a pyramid of mormon cheerleaders [ouch?] some minor rope scars could be imagined in one inobvious spot- oh, and there is a big heart with an arrow through it scratched underneath the arch, with the letters D&S TLA, but some say that has always been there...?).
the real judgement-lacking fiasco was likely not the climb itself , but the fact that his ascent was then documented on the front page of some SLC paper, and was quickly widely known about and discussed by climbers and non-climbers alike. no one in the oversight happy democratic congress had to subpoena those pics, but instead they made their way to the front page voluntarily, even triumphantly, and likely in the proud sponsored-guy 'hot flashes' inspired 'look at me' pattern we all expect such bold ascents to get their press these days (there was, apparently, no video available of any TR rehearsal, nor of rapping or pulling ropes from the arch).
problem w/ that is that part of the world in general, like in so many other parts of the vast mosaic of federally managed areas, climbers in general face challenges to our access, via fixed anchor bans and the like, and the PR this boulder problem gave us all was not the kind that helps us look responsible as a community, and of course there was plenty of (quite predictable) outrage, from both inside and outside of the climbing community.
the problem most everyone i know has with this episode was that DP and his entourage could have had their early morning fun and it's quite likely that no one would have been the wiser, so it was really the self promotional aspect at (potentially) the expense of the climbing community which left a sour taste in the mouths of many people, and that's just exactly what o-dub's song pokes fun at w/ its "look at me" lyrics.
disclaimer: the above may be entirely full of inaccuracies and exaggerations which unintentionally slander one or more professional climbers (or former professional climbers). i in no way am trying to get beat up by any of werner's famous pals, or sued by law school interns whose prose does not impress some lawers posting on this thread, i was just answering a question up-thread, so thanks in advance for not beating me up or taking away my assets!

Is ML the Dean Potter or the ODUB character? How about Will Smith as Dean and Valerie Bettenelli as Katie Brown (using Metolius Cams on Tombstone and not Black Diamond's fine products)?
Also, as the world turns and the plot thickens, any lairwers want to advise if ODUB could sue Dean for causing his access to be restricted? Maybe a class action suit?

i know Odub and he is a good guy and has fun with his music. last time i checked this is still a free country.
as for DP- well now forrest gump works real good here:
"stupid is is stupid does"... so if DP is offended, then maybe he will think about his antics before he acts them out.
we all have done stupid sh#t (my list is quite long) and you set your self up for the blows to follow when to create your media circus to record your climbing follies...
i liked climbing better when there was no money in it and everyday day that i went climbing it was for my dreams, my visions and my pleasure....
so if DP gets railed and folks make songs and write books and blogs, then deal with it cause this is life in the 21st century!!!!

Lawyers,
If he did not get cited, with the publicity created by the ascent, would it not mean that now access has actually been increased? If one were to send DA, get cited, retain a lawywer. Then go to court. Could you not say that the precedent that has been set due to lack of action on aforementioned events is cause for dismissal of the citation. Or better yet have I watched to many episodes of Law & Order.
