Damned inconvenient those mandatory sentencing guidelines when they're applied to a white man training a loaded rifle on Federal agents. Fewer complaints when the perp or victim are black.
The Federal Sentencing Guidelines were part of Clinton appeasing the Republitards so he could get any legislation through Congress. Lock 'em up and throw away the key was the general idea.
No parole for federal crimes! WTF!!! Removing the good behavior incentives.
So what incentive does someone in Federal prison have to improve themselves to get out early? Probation is still available with Federal supervision after release.
In fact the Supreme Court recognized the flaws in mandatory sentencing in United States vs. Booker in 2005: mandatory sentencing violates the 6th Amendment: the right to trial by jury. e.g. the jury couldn't lessen the sentence.
Due to Booker, guidelines are now advisory only.
And the sentences are still subject to appellate review.
The prosecutor may argue for a lesser sentence than imposed by the Judge. Looks like that didn't happen here.
The guidelines also allow for increasing a sentence for "government disruption", using weapons in committing the crime, how the weapon was used, and how much it endangered others.
Pointing a long gun at a Federal LEO with a lot of people around will be more harshly sentenced than just walking around in the bush, spouting off and pretending to be a tough guy. The judge still has a LOT of freedom in the sentencing. But No Parole is still the law.

Cliven Bundy is an idiot. No question. But I'm almost starting to like the guy. He is becoming a stalking goat for Big Brother's abuses.

The local water police here have night vision gear, an MRAP, and real surplus M4's with grenade launchers (sans grenades). They literally have nothing to do but get all these free goodies.
So you can bet a real federal thug agency will treat every confrontation like it's Fallujah.

MISSOULA, Mont. – Backcountry Hunters & Anglers stated that “justice must be served” in the conspiracy case against scofflaw rancher Cliven Bundy, his sons and a supporter following a federal judge’s declaration of a mistrial in the case this morning.
BHA President and CEO Land Tawney issued the following statement:
“Cliven Bundy and his followers are lawbreakers who continue to disrespect our government, our public lands and waters, and the citizens who own them. Today’s decision fails to change this fact: The Bundys and their comrades employed violence and lawlessness in an effort to steal from the American people. We as a nation cannot tolerate such actions, and these individuals must face the consequences. We anticipate a new trial being pursued against the Bundys and their accomplices. Justice must be served.”
Tawney continued:
“Worth remembering at this crucial moment is that America’s public lands – including national wildlife refuges, Forest Service lands and BLM lands – belong to all of us. We, their rightful owners, must stand up on behalf of our shared heritage and the outdoor opportunities they represent. To do otherwise is to neglect our patriotic duty.”
Ammon and Ryan Bundy led a group of anti-government extremists in a 40-day occupation of the Malheur National Wildlife Refuge in Oregon in early 2016. BHA members traveled to the refuge to witness the occupation and speak up on behalf of public lands and public land owners.

I do not have a problem with the dismissal. In a way it takes the air out of Bundy's sails with respect to the argument that the Federal government is conspiring against him.
Bundy will be waving the dismissal order as some sort of evidence that he is right, while at the same time ignoring the order to pay his grazing fees or get his mangy cows off our land.
