LAS VEGAS — The top federal prosecutor in Nevada vowed a third trial Wednesday for two men accused of armed assault on a federal officer in a 2014 standoff that stopped a cattle roundup near the ranch of states’ rights figure Cliven Bundy.

“There’s no question about us proceeding forward. Just so the record’s clear,” Acting U.S. Attorney Steven Myhre told Chief U.S. District Judge Gloria Navarro a day after a jury acquitted two defendants of all 10 charges but failed to reach verdicts on four charges against Eric Parker and two counts against Scott Drexler.

“Raising a firearm against a federal law enforcement officer, or any law enforcement officer, is a crime,” Myhre declared as he lost a bid to keep the two men in federal custody until the next trial. “That’s why we brought (Parker) to trial and … intend to try him a third time.”

Parker and Drexler were photographed during the standoff on a high Interstate 15 freeway overpass near Bunkerville pointing rifles through concrete sidewall barriers toward heavily armed federal agents in a dry riverbed below. The agents were guarding corrals of rounded-up cattle and facing flag-waving unarmed men, women and children.

Navarro ruled that Parker, 34, of Hailey, Idaho, and Drexler, 46, of Challis, Idaho, can return to their home state to await trial, which she scheduled Sept. 25. She also scheduled an Aug. 31 hearing to determine if the date will stand.

Keeping the September date for the two men would mean another delay starting the trial for Bundy, four of his sons and six other defendants who have been in federal custody since their arrests in early 2016 despite invoking their rights to a speedy trial.

The court found that Bundy and his father actually first began grazing their cattle on the Bunkerville Allotment in 1954 and used it for several years. They paid for cattle grazing again from 1973 until 1993, when Bundy paid the last fees for his final grazing application for the period from December 1, 1992, through February 28, 1993.

On January 24, 1994, the Bureau of Land Management delivered a Proposed Decision Order to Remove and Demand for Payment to Bundy by placing it on the dashboard of Bundy's vehicle while he was in the vehicle. BLM officials allege that Bundy became agitated, descended from his truck and accused the BLM of harassing him. He then returned to his truck, threw the proposed order out of the window and drove away. One of Bundy's sons then picked up the document, tore it to pieces and threw it on the ground.

On February 17, 1994, the BLM issued a final decision canceling Bundy's range-grazing permit. Bundy subsequently informed the BLM in several administrative notices that he intended to graze cattle "pursuant to my vested grazing rights." Bundy failed to demonstrate the existence of any such special rights when given an opportunity to do so in court.

Obama on Thursday declared the nearly 470-square-mile Gold Butte National Monument in an area across the Virgin River from the Bundy homestead, about 80 miles northeast of Las Vegas.

The local Moapa Band of Paiute Indians, conservationists and advocates praised the Gold Butte designation, which U.S. Sen. Harry Reid, D-Nev., who is retiring after 34 years in Congress, backed. They said the area is home to threatened wildlife, such as the desert tortoise and bighorn sheep, and contains ancient rock art and artifacts, unique geologic features, rare fossils and recently discovered dinosaur tracks.

Why does the U.S. put the worst attorneys on these cases, only to lose them. Good god, they all should be in jail, especially those involved in the Malhuer refuge. Sheesh!

If Clan Bundy wants us to respect the acquittals in the criminal case then they had better respect the civil judgement and pay the millions in grazing fees the courts deemed that they owe, and get their mangy cows off FEDERAL LAND
