We can either witness the decline of America, along the current trend, or we can make an effort to stanch the decline.

Donald Trump Made Justice Kennedy an Offer He Couldn’t Refuse

http://flip.it/2hbHKe

This is so fuked up. It's basically M13 in suits ruthlessly gaining turf and power with a trail of collateral damage in the form of wrecked families and a tattered constitution.

Companies should not be allowed to contribute to any vote process whatsoever.

Only individuals, registered voters, and capped at $1000 per election per candidate or issue. Done.

No PACs. No Corps. No rich deep pockets. A truly leveled playing field.

DMT

That is certainly more consistent and fair. But our Supreme Court protects unlimited donations by the wealthy and corporations under Free Speech but then turns around and guts the ability of Unions to contribute.

I expect the one-sidedness to increase after Kennedy's replacement.

if the democrats took the senate trump wouldn't be able to seat anyone on the list of dominionist Christians approved nominees that he is shopping...

I expect R's to confirm before the mid-terms.

If the Dems do take the senate, I would be in favor of them not seating any more conservative nominees. This would be in the category of lessor of two evils. Having your institutions paralyzed by procedure is one more nail in the coffin of having a functioning democracy.

This all still comes back to the undemocratic process of the DNC followed by the atrocious campaign run by Hillary (how does a Dem lose, Michigan, Wisconsin and Pennsylvania?--by being completely out of touch)--unfortunately for us, the dogs have been unleashed.

or we can kiss birth control goodbye...

Jessica Mason Pieklo, a law professor who works as a legal journalist for Rewire, mentioned briefly on a Wednesday edition of her podcast "Boom! Lawyered" that she was worried about the fate of the 1965 Griswold v. Connecticut decision and the 1972 Eisenstadt v. Baird decision, which together created the right of privacy and overturned state laws restricting contraception access.

You can "kiss birth control goodbye" if democratically elected legislators decide to make it illegal.
If the majority of people want to make birth control illegal, well, we live in a democracy (of sorts), so you're just going to have to try to elect legislators who pass laws you agree with.

No more crying to mommy and daddy (Supreme Court) to bail you when the legislators do things you don't like!

(But there still is a role for the federal courts of course to strike down laws that conflict with the Constitution--we've seen some examples of that recently where the Court had to knock out the illegal mandatory union payments for government workers because that violates the First Amendment. Birth control, however, isn't addressed in the Constitution, so it's up the legislators. If you really don't like that, you could try to amend the Constitution.)

Chief Justice John Roberts, after he was nominated by George W. Bush in 2005, drew attention because of a draft article he wrote as senior adviser to the attorney general under Ronald Reagan, in which he approvingly cited Justice Hugo Black's dissent in Griswold. As much as one might like the idea of a right to privacy, Roberts wrote, that did not "mean that courts should discern such an abstraction in the Constitution."

Yes, yes, that's it exactly.
No right of privacy in the Constitution whatsoever. (But you do have some rights against "unreasonable search and seizure," I suppose.)
But don't forget, it is important for the Court to strike down laws that actually violate the Constitution (see Citizens United, a most excellently reasoned decision).

Let's rejoice that Kennedy is gone and we'll get another brilliant jurist in the nature of Scalia soon--Oh happy day!

Yeah let’s celebrate losing the only centrist with an open mind, and replace him with someone who can’t admit how biased they are. But hey if he or she fits in with your agenda who cares if justice or other people suffer.

don't you remember?

Obama was created in a petri dish in Kenya, educated in a Syrian terrorist training camp

sent to Hawaii with a fake news birth certificate

all with the intention or becoming President in order to destroy American society

over and over, he proves his own ignorance every time he opens his mouth

he knows only how to call others childish names on the playground

and lives in fear that one day they will all turn on him

poking at the soft belly of his shallow intellect

bullies are all the same, little boys trying so hard to be grown up bad asses
