I knew if I read enough of your posts, I'd find something with which I'd agree. Your post on the President and Michael Vick was right on target. Thanks much for a clear and cogent argument.

I would add, as someone who faced a federal prosecution and pleaded guilty myself, I have a skewed perspective. Anyone convicted of a federal offense who comes back to be a productive member of society has done us all a favor, and overcome great odds.

Federal prosecutions severely punish those who have the temerity to contest their guilt. The punishment is about five-fold greater if they go to trial and lose. The Wesley Snipes case is a perfect example. His sentence for misdemeanors exceeds what he would have received had he pled guilty of a felony!

My guilty plea saved me tens of thousands of dollars in legal fees, as well as a likely prison sentence of five years and a fifty thousand dollar fine if I were found guilty after trial of the most serious charges. The $100 fine and six months I received, while odious, insured that I would not face a risk I could not afford to take.

Most federal prosecutions end in a plea agreement, just as mine did. I suspect, though, that most defendants were like me -- risk averse. Federal juries are impressed with FBI testimony -- even if coached, incomplete or misleading (The federal prosecutor in my case lied to the court, and tried to present impermissible evidence).

If people choose to go to trial in a federal prosecution, either they have nothing to lose, or they really believe they are innocent, have substantial resources to pay private counsel (to make it a fair fight) and don't care about what happens if a jury disagrees. For that reason, you need to go easy on the "whining." Sometimes, it bemoans injustice.

Kodos somehow managed to post so many threads so quickly that everyone was in essence locked out from participating here for some time. Pages and pages of posts of (I believe) his victory in the bet. The site may as well have gone black. The content of the posts were not the issue - it was the complete take over of supertopo that was.

edit: and imo this place is more restrained than it once was.
