What an awful situation. I think there is enough support here from people who know the man, to be confident in his innocence. Or at the very, very minimum, assistance from our governement in seeing that his appeal is heard. This thread could be a good "added link" for people to include if they are doing an email "Please Help" thing(because of the personal supporters).

I will follow the suggested instructions on the Help site, and address those politicians whose jurisdiction I live under.

Why no "official" US involvement? Diplomacy? His hometown senator ? (Why isn't this front page stuff (or did i miss it- don't watch much tv)?

Never thought I 'd type this, but.. FT, Your thoughts on the behind the scenes scene? Curious.

All the evidence as presented here would seem to indicate this man was railroaded...strange that one criminal testifying is taken into consideration when ten other eye witnesses are not as they 'work for him and only want to protect their jobs'...

This could one day happen to any one of us, yo...

Volz has some real trouble when the physical evidence was destroyed. Now it's the "trustworthy" local villagers versus the hottie dating gringo. Has to go to appeals and then I'll bring in some politicos.

There were two paragraphs in one of the stories in the original post that were a telling indication of what's really at play here.

Eric Volz saw himself as a bridge between American baby boomers looking for beachside dream homes and local families of fishermen and laborers in this languid Pacific village. A surfer turned real-estate broker, Mr. Volz, 27 years old, published a bilingual magazine called El Puente -- literally, The Bridge.

Ms. Alvarado, an organizer for the ruling Sandinista party, arranged for truckloads of protesters to surround the tin-roofed courthouse for a Dec. 7 preliminary hearing.

(1) The gangsters are back in charge and Voltz was a threat to their power base.
(2) Mom is tight with these same political bosses.
(3) She complains about the gringo to them.
(4) Some muscle is sent to visit the daughter to persuade her to stay away from the Gringo.
(5) She refuses, agument insues resulting in her death.
(6) Mom is a willing participant in the coverup

Day 5 Strategy: Contact the Nicaraguan Embassy

We urge you to send this form letter to Fernando Coronel, the Press Director at the Nicaraguan Embassy in Washington:

Fernando.Coronel@embanic.org

To the Honorable Fernando Coronel:

In the spirit of goodwill that exists between many Nicaraguans and Americans, I respectfully write to ask that you to pay considerable attention to the case of Eric Volz. He is an American citizen currently incarcerated in the La Modelo prison, convicted of a crime he did not commit.

Eric's case is currently in the appeal process. As a result, we want to turn your attention to the fact that the justice system is in breach of articles 7 and 10 of the Universal Declaration of Human Rights which state, "All are equal before the law and are entitled without any discrimination to equal protection of the law" and "Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him."

Please help see to it that Eric's case be reviewed fairly and that justice be done. If interested, below is a link to the Declaration of Human Rights: http://www.unhchr.ch/udhr/

Well, thanks for the heads-up Chris. I watched that piece, and to me, it seemed as though we were finally being presented with a clear picture.

Eric Volz was wrongfully convicted. The judge made many clearly erroneous rulings that amount to an abuse of her discretion. I mean, COME ON! That judge was younger and cuter than me. We don't get judges like that here in America. Daddy must have bought her that job.

And the mother of the murder victim? Truly hideous and worthy of punishment.

So I'm bumping this to say, this really does deserve your attention.

Hello All:

I have been following the plight of Eric Volz and not only has Nicaragua violated the Universal Declaration of Human Right but in my opinion the Nicaraguan Government and Penal system has also violated the Gevena Convention Section 3 of subsection part 1, with their uneathical and diplorable inhumane treatment of Eric Volz that has lead to his dangerous and rapid declining health condition.

As you are all aware that unjustly and wrongly accused Eric Volz is currently being housed at La Modelo prison located 20 minutes outside of Managua Nicaragua. The conditions at La Modelo are inhumane and diplorable to say the least. Wrongly accused Eric Volz is in constant fear for his life due to the grief stricken head of the left wing revenge seeking santanista mother-Mercedes Alverez of Eric's unfortunate murdered ex-girl friend. While La Modelo prison officals have Eric under guard for his protection to ensure against attacks from other La Modelo inmates seeking to also kill him.

He is still subjected to starvation and constant dehydration due to a lack of a water supply, not to mention that disease and aids run rampant in this facility. Eric has already been brutally and viciously attacked by another inmate in the first Nicaraguan prison that he was housed in. Revenge seeking, left-wing head of the santanista regime,Mercedes Alverez and family, time and time again have publicly boasted about having Eric killed in prison.

The Geneva Convention Section 3 of subsection Part1-General Provisions States:

1.) Persons taking no active part in hostilities , including members of armed forces who have laid down their arms and those placed in hors de combat by sickness, wounds, detention or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, color, religion or faith, sex, birth or wealth, or any other similar criteria.

2.) To this end following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above mentioned persons:

a.) violence to life and person, in particular murder of all kinds,
b.) the taking of hostages;
c.) outrages on personal dignity, in particular humiliating and degrading treatment;
d.) the passing of sentences and the carrying out of executions without previous judgement pronounced by a regularly consituted court affording all judical guarantees which are reconized as indespensable by civilized peoples.

2.) The wounded and sick shall be collected and cared for.
An impartial humanitarian body, such as the International Comittee of The Red Cross, may offer its services to the parties of conflict.

eric went to my highschool for awhile when i was a freshman and he was a junior. we knew some of the same people, and i always appreciated that he was never mean to me even tho i was a freshman and he was an upperclassman. he always was super nice and had a great smile. it's incredibly frustrating to read of the "justice" process in nicaragua. eric volz deserves justice.

AP is reporting that Eric Volz has been freed after a successful appeal of his 30-year sentence. Not yet confirmed if he has left the country.

Hell of a XMAS present for his family.

If that's true, it's fantastic news. A lot of people will be psyched to see him let out.

Unfortunately for every case like this where justice finally gets done, there are ten others in which it isn't. Let's remember to try and help all victims of such injustices.

It's true.

Outside posted an article 40 minutes ago.

http://outside-blog.away.com/blog/2007/12/eric-volz-relea.html

"The ruling called for Volz’s immediate release as the country's attorney general vowed to appeal the decision to Nicaragua’s highest court."

I hope he's going directly to the airport and getting the hell out of Dodge.

That WSJ article says "Once freed, Mr. Volz was expected to depart Nicaragua immediately, said a Volz family spokeswoman, who declined to comment further" You might want to keep that under wraps! Isn't it possible that one condition of his release pending the appeal is that he not leave the country?!

Anyways, that is great news, since this smelled bad all along.
