Well, that needs a picture then. Jeanie Buss, Jerrys daughter (does she own the lakers now?) seen here relaxing, says that the comments were reprehensible.


Hope that furthers the conversation along although it hardly qualifies as the certain analogy Zbrown suggests.

Actually that seems a little too convenient--
-rich owner (and A-hole) makes racist comments, specifically about Magic,
 NBA forces owner to sell the team to . . . Magic?

Somehow I'm not sure that will fly, we'll see.

And about forcing him to realize $500M gain or whatever--I'm not a tax guy, but now that I think about it, I don't know if Sterling will go for that. If he dies and leaves the team to his heirs, they get a step up in the basis value of the team, so they don't have to pay capital gains tax on it when they sell (they still have to pay inheritance tax) except to the extent it increases in value after his death.
If he has to sell now, he has to pay HUGH cap gains tax, and then the heirs still have to pay inheritance tax.

If I've misstated that tax implications of this, I hope someone corrects me. But otherwise, I'm going to predict NO SALE, voluntarily at least, and we'll what happens if the NBA tries to force him to sell. I'm a bit skeptical that they can do that, but I don't know, and it sounds like the so-called experts disagree.

It will be interesting to see how many seats are empty at the game don't you think Survival? Unless the NAACP is still going to give him the humanitarian award of course....

I have a feeling that there won't be many empty seats, especially after the NBA ruling today. It makes everyone feel better. Plus, it's a great playoff series.

Now if the commish hadn't taken a stand, and if Sterling were still in charge next season, it might be a different story.

That's my not-so-professional opinion.

How is this not a clear-cut 1st Amendment winner of a case in favor of the bigot? Even if it wasn't a private conversation, it's still valid.

Ever hear some black or Mexican radicals call for killing whitey? I can help ya out if you don't know already. Calling for violence is not protected by the 1st.

Racial discrimination in a private conversation is protected.

We should be careful where this is allowed to go. This could get many un-suspecting people in jail. Assuming we're willing to apply equal penalties under the law that this guy got.

He didn't get arrested, he got voted off the island according to the charter rules of a private organization he belonged to.

What I meant is what if it is violent rhetoric. Many rappers may find themselves in jail, despite us knowing it is just a song.

But it gets worse than that. Some, specifically black, activists call for killing white children. Why is that not criminal?

The head of La Raza has made some pretty violent statements too. Jailable? Or free-speech?

The 1st amendment only applies to the government's relationship with the populace.

They CAN be prosecuted if it can be shown that their speech specifically led to murder. That's a pretty high bar, as it should be.
But irrelevant to contracts between private parties.
Every year I sign two or three Non Disclosure Agreements with clients. If I ever disclose any of their intellectual property I can be sued for damages.
That's a mutual contract, not signed under duress. And it is valid.

I not defending the man. I'm defending his speech that was made in a private conversation. He was not aware this was going to affect the league. He was having a private conversation.

As such, shouldn't the 1st defend his private speech while released without his permission?

As they all have a legal right to do.
His franchise is likely losing value by the minute.
A smarter man would get rid of the team as quickly as possible, take his mega millions and flee to Switzerland.

I can list other examples. There's a double standard. And the 1st Amendment wasn't designed for that.

I haven't read the contract, but I would be surprised if it included any language that Attorney Sterling needed to be aware that his behavior did or would negatively affect the league.

Now as to whether V. signed a non-disclosure agreement with Attorney Sterling, that is another issue.

In my faovrite legal phrase he "knew or should have known".

The NBA's bylaws allow for owners to be expelled from the league, though that power is reserved for limited circumstances, such as the inability to operate financially, gambling on league games or fixing games.
The more likely route, which Silver took, lay within Article 35 of the NBA Constitution, which allows the commissioner to indefinitely suspend owners for "conduct prejudicial or detrimental to the association."

This is a contract between Lizard Face and the NBA. Sure they'll fight about it in court. As I said above. A smarter, wealthy man would cut his losses and get outta Dodge. Why Switzerland? because it's a great place for Rich Scoundrels.
