For many of us this is a very light judgement. For a professional climber etc this could equal a couple of lean years. I am curious if this ended up a felony? If so, not good. I know I am opening myself up to tirades on st but frankly in my view the young man just needs to grow up. Maybe this episode will help the process.

I report the facts.

The PACER site has just a little info.

Felony? Not sure.

Plead to what crimes? Unknown

Payment of $175 a month till $4000 is paid off.

Got his gear back. Could have been forfeited because the equipment was used in the commitment of the crime. Like a gun, burglary tools, or drugs, or getaway car.

Sure took a plea real quick in legal time.

Didn't even fight it like he fought his DUI.

Lets here the whole story without any lies, Ammon.

Court went well, they offered me a reasonable deal, dropping most of the charges, (of course) but had to hold out on one issue, so I obviously plead not guilty. The new magistrate seems like a fair judge and good character.

Mtucker, you're too harsh.

When I think of criminal activities; base jumping, pot smoking and beer drinking (as long as you're not driving) do not come to mind.

Go after the really bad guys; rapists, murderers and robbers.

Most of us who lived in the park broke at least two of these three offenses. Give it a rest already.

We were given a ticket, not charged with a crime, so for your information, I'm not a criminal.

They why did you need a lawyer???

36 CFR is a law and you broke it.

You violated the Wilderness act as well. It is a law too.

Point proven. You are a criminal.

You got busted, charged, convicted (plead), and fined.

Criminal = a person charged with and convicted of crime

Crime = Crime is the breach of rules or laws

Misdemeanor = is a "lesser" criminal act.(Many misdemeanors are punished with monetary fines.)



TITLE 36 - PARKS, FORESTS, AND PUBLIC PROPERTY

CHAPTER I - NATIONAL PARK SERVICE, DEPARTMENT OF THE INTERIOR

PART 1 - GENERAL PROVISIONS

1.3 - Penalties.

(a) A person convicted of violating a provision of the regulations contained in parts 1 through 7, 12 and 13 of this chapter, within a park area not covered in paragraphs (b) or (c) of this section, shall be punished by a fine as provided by law, or by imprisonment not exceeding 6 months, or both, and shall be adjudged to pay all costs of the proceedings.

(b) A person who knowingly and will- fully violates any provision of the regulations contained in parts 1 through 5, 7 and 12 of this chapter, within any national military park, battlefield site, national monument, or miscellaneous memorial transferred to the jurisdiction of the Secretary of the Interior from that of the Secretary of War by Executive Order No. 6166, June 10, 1933, and enumerated in Executive Order No.

6228, July 28, 1933, shall be punished by a fine as provided by law, or by imprisonment for not more than 3 months, or by both.

Note: These park areas are enumerated in a note under 5 U.S.C. 901.

(c) A person convicted of violating any provision of the regulations contained in parts 1 through 7 of this chapter, within a park area established pursuant to the Act of August 21, 1935, 49 Stat. 666, shall be punished by a fine as provided by law and shall be adjudged to pay all costs of the proceedings. 16 U.S.C. 462.

(d) Notwithstanding the provisions of paragraphs (a), (b) and (c) of this section, a person convicted of violating 2.23 of this chapter shall be punished by a fine as provided by law. 16 U.S.C. 460.
